These Terms and Conditions ("Terms") govern your access to and use of the Xtrafyl platform, including the Customer App, Driver App, and Provider Web Panel.
By accessing or using Xtrafyl, you agree to be bound by these Terms.
1. Platform Overview
Xtrafyl is a technology platform that enables:
- Customers to request on-demand vehicle-related services
- Service Providers to receive and manage service requests
- Drivers to fulfill services on behalf of Providers
Xtrafyl does not provide services directly and is not responsible for the execution of services beyond facilitating the connection.
2. User Categories
2.1 Customers
Individuals who request services such as towing, fuel delivery, EV charging, car wash, detailing, breakdown assistance, tire repair, and similar services.
2.2 Providers
Businesses or individuals registered to accept service requests and manage drivers.
2.3 Drivers
Individuals authorized by Providers to perform services.
3. Provider Agreement
By registering as a Service Provider, you agree to:
- These Provider-specific Terms
- The general Xtrafyl Terms of Service
- All applicable local, state, and federal laws
Providers act as independent contractors, not employees or agents of Xtrafyl.
4. Provider Eligibility & Requirements
To register and remain active, Providers must:
- Hold valid business licenses and permits
- Maintain required insurance coverage
- Pass verification and background checks
- Maintain accurate business information
- Ensure a minimum average rating of 4.0 stars
- Comply with all applicable laws and regulations
Failure to meet these requirements may result in suspension or termination.
5. Service Standards
Providers and Drivers agree to:
- Respond to service requests promptly
- Maintain professional and respectful conduct
- Follow all safety protocols
- Use properly maintained vehicles and equipment
- Deliver services accurately as described
Xtrafyl may monitor service quality for platform integrity.
6. Driver Management (Provider Responsibility)
Providers are solely responsible for:
- Verifying driver identity, licenses, and credentials
- Conducting background checks
- Training drivers adequately
- Managing driver schedules and availability
- Addressing customer complaints related to drivers
Drivers are not employees of Xtrafyl.
7. Location & App Usage Requirements
7.1 Location Usage
Drivers must enable location access in the Driver App during active services to allow:
- Navigation to customers
- Real-time service tracking
- Accurate dispatch and completion verification
Disabling required permissions may result in service cancellation or account suspension.
7.2 Proper Use
Users agree not to:
- Manipulate location data
- Accept services they do not intend to complete
- Misuse the platform for fraudulent activity
8. Payments & Fees
8.1 Provider Earnings
- Earnings are based on completed services
- Platform service fee: 15% per transaction
- Payouts processed weekly (Mondays)
- Minimum payout threshold: $50
8.2 Payment Processing
Payments are processed through secure third-party providers. Xtrafyl is not responsible for delays caused by banking systems.
9. Service Areas
Providers must:
- Define service areas accurately
- Accept requests only within defined zones
- Update service areas when needed
Accepting requests outside declared service areas may affect performance ratings.
10. Equipment & Insurance
10.1 Equipment
Providers must maintain:
- Safe and roadworthy vehicles
- Required tools and safety equipment
- Clean, professional presentation
10.2 Insurance Requirements
Minimum coverage required:
- General Liability: $1,000,000 per occurrence
- Auto Liability: $500,000 per occurrence
- Workers' Compensation: as required by law
Proof of insurance may be requested at any time.
11. Account Suspension & Termination
Xtrafyl may suspend or terminate accounts for:
- Violations of these Terms
- Fraud or misuse of the platform
- Repeated customer complaints
- Ratings below 4.0
- Failure to maintain licenses or insurance
- Safety or legal concerns
Termination decisions are final.
12. Limitation of Liability
Xtrafyl is not liable for:
- Acts or omissions of Providers or Drivers
- Service quality or outcomes
- Property damage or personal injury during service execution
- Disputes between users
Users agree to use the platform at their own risk.
13. Indemnification
Providers and Drivers agree to indemnify and hold Xtrafyl harmless from any claims, damages, losses, or legal actions arising from their services or conduct.
14. Modifications to Terms
Xtrafyl may update these Terms from time to time. Continued use of the platform after updates constitutes acceptance.
